White Florida man calls 911 during a dispute with his mother. Then he sees the Black responding deputy and allegedly dials 911 a second time

Police say he is a frequent caller on the 911 line.

A white man in Florida who was involved in a domestic dispute with his mother reportedly contacted 911 services to help intervene, only to allegedly make a second call when he saw a Black officer respond on scene. 60-year-old Frederick Toder is now being charged with the misuse of 911 services.

According to an arrest affidavit obtained by the Atlanta Black Star, the incident took place on Tuesday, Oct. 27, when Palm Beach County Sheriff’s Office deputies responded to a domestic disturbance call at a home on Juego Circle in Boca Raton around 9:10 p.m. Toder told deputies that his 84-year-old mother, Marilyn, wanted him removed from the residence and transferred to a group home or mental health facility due to a disagreement that happened earlier in the day.

Toder claimed his mother had upset him by making remarks suggesting that a Black maintenance employee at the community clubhouse should be his “master,” while he should be the “slave” who “needed to be controlled.” Marilyn, on the other hand, argued that she confronted Toder due to his alleged “inappropriate” and “destructive” behavior at the clubhouse.

Toder allegedly did not want a Black person in his home

According to Marilyn, her son was “throwing shrimp tails onto the floor, urinating outside in corners rather than utilizing restroom facilities, and damaging property, including window blinds,” the arrest affidavit said. She also told deputies that Toder routinely uses racially offensive language toward Black individuals.

During the investigation, two other deputies, one of whom was Black and identified as Deputy Digsby, were monitoring Toder while Marilyn was being questioned. The arrest affidavit alleged that Toder “became visibly irate” when he noticed Deputy Digsby enter the residence and later protested his presence solely because of his skin color.

While deputies were still inside the residence investigating the report, Toder allegedly made another 911 call and requested a different set of deputies to come. “Frederick’s stated reason for requesting additional deputies was his objection to Deputy Digsby’s presence based on race, rather than a newly reported emergency requiring additional law enforcement assistance,” per the arrest affidavit.

Toder was arrested for repeatedly calling 911 in the past

Toder was subsequently arrested without incident at around 9:41 p.m. He was booked into Palm Beach County Main Detention Center.

According to Atlanta Black Star, this wasn’t the first time Toder was arrested on such charges. In 2016, the Florida resident was accused of contacting 911 at least eight times in a span of four days on various matters, including complaints about his “father being annoying,” his “parents hurting his feelings,” and his “mother leaving a plastic bag on the ground,” per the arrest affidavit filed by the Highland Beach Police Department.

Toder was reportedly released from custody after posting a $1,000 bond following his latest stint, and is slated to make a court appearance on Dec. 12. Under Florida law, misuse of 911 services is classified as a first-degree misdemeanor, punishable by a fine of up to $1,000 and up to one year in jail for each of the first four offenses.
