Kim Kardashian just won a legal battle that left the guy who sued her on the hook for $167,000 in legal fees. The ruling came after a judge dismissed Ivan Cantu’s lawsuit, which claimed Kardashian caused him emotional distress by accidentally posting his photo on Instagram. Now, Cantu has to pay up or face even more financial trouble.
The whole mess started in February 2025 when Cantu, a New York-based project manager, sued Kardashian over a photo mix-up. She had been posting about a Texas man with the same name, Ivan Cantu, who was convicted of murder in 2001 and executed in February 2024.
According to Us Weekly, Kardashian had been advocating for the prisoner, sharing 16 Instagram Stories over 10 days to raise awareness about his case. But one of those posts, uploaded two days before his execution, accidentally used a photo of the wrong Ivan Cantu. Kardashian’s legal team corrected the mistake, removing the photo within hours and apologizing to the New York Cantu.
But that didn’t stop him from filing a lawsuit
Cantu claimed the incident caused him emotional distress, loss of sleep, and even PTSD. His case was dismissed in November 2025, and Kardashian wasted no time pushing for legal fees. She initially asked for $186,000 but was awarded $167,000 after a judge sided with her again.
Cantu tried to fight the fee request, arguing that paying would financially ruin him. He also pointed out that Kardashian, with her billion-dollar net worth, didn’t need the money. But the judge wasn’t swayed. Kardashian’s legal team had already made their case clear: the lawsuit was an attempt to exploit a simple mistake tied to her free speech rights. Her lawyer, Michael Rhodes, called it a “cash-in” on an error that was fixed almost immediately.
This isn’t the first time Kardashian has had to defend herself against legal threats over her advocacy work. She’s been vocal about criminal justice reform for years, using her platform to push for clemency and exonerations.
In a court declaration, she explained her motivation, saying she engages in this work “because I am passionate about it and without any commercial benefit or intent.” She also detailed how she got involved in the Texas Ivan Cantu’s case, saying she was moved by his claims of innocence and troubled by issues with his conviction.
The legal fees Kardashian racked up weren’t cheap
Her lead attorney, Emil Petrossian, charged $900 an hour, down from his usual $1,100 rate, while another associate, Alina Gatto, billed $600 an hour. The total came to $145,000 in legal fees, plus additional costs that pushed the final amount to $186,000. Now, with the judge’s ruling, Cantu is on the hook for nearly all of it.
Kardashian’s team has been firm about their stance from the beginning. In a statement to Us Weekly back in February 2025, Rhodes called the photo mix-up a “simple mistake” tied to her advocacy work. He emphasized that the image was taken down almost immediately and that Kardashian had no intention of causing harm. “We’d prefer to solve this without litigation, but of course will defend Kim as needed,” he said at the time.
The case highlights the risks of high-profile advocacy
Kardashian’s work in criminal justice reform has earned her praise, but it’s also opened her up to legal challenges. In this instance, a simple photo error turned into a year-long legal fight, with Kardashian coming out on top. Her victory sends a message: if you sue her over a mistake, you might end up paying for it, literally.
For now, Cantu has to figure out how to cover the $167,000 bill. As for Kardashian, she’s likely moving on to her next cause, undeterred by the legal drama. After all, when you’ve got a billion-dollar net worth and a team of high-powered lawyers, a six-figure legal fee is just another line item.
