CNN attorney sends stern warning to Trump White House after reporters are left off Air Force One list

Fighting retaliation.

CNN is threatening to head back to court if the White House does not stop blocking its journalists from Air Force One. The network sent a stern warning to the administration this week. It demands that the White House restore full access for its news crews.

Ted Boutrous, an outside attorney for CNN, sent a letter to the Department of Justice (DOJ) on Monday, October 19, 2026. He stated that the network will be forced to pursue additional judicial relief if the current situation continues. The letter includes a deadline of Thursday at 5:00 PM Eastern.

The White House has been leaving CNN off the list for presidential travel, disrupting a tradition of pooled TV coverage that has lasted for 45 years. The five major networks take turns providing this coverage.

Global news organizations rely on this footage for their own shows

Boutrous wrote that the network has been barred from performing its pool duties on multiple occasions. He noted that the network was recently excluded from the travel pool for a trip to Georgia and Florida. In a show of solidarity, other major networks have refused to fill in when CNN is blocked.

The attorney argued that these actions are retaliatory. “These efforts to retaliate and discriminate against CNN based on the content of its news coverage are mistaken, counterproductive, and unlawful,” Boutrous wrote. He added that the network is prepared to fight as long as is necessary to secure its rights.

This dispute is an extension of a previous legal battle. Trump previously banned CNN, MS NOW, and Politico from White House grounds one month ago. The outlets sued, alleging violations of the First and Fifth Amendments. US District Judge Tim Kelly eventually issued a preliminary injunction in their favor. He stated that the ban likely amounted to unconstitutional viewpoint discrimination.

The administration restored White House access after that ruling

However, it appears to be finding other ways to target specific journalists. The White House has provided no written notice and offered no explanation for excluding CNN from recent trips.

The administration seems to be following a playbook used against The Associated Press in a past case. The AP had sued when Trump blocked its reporters from the Oval Office and Air Force One. The president had taken action because he wanted the news wire to use a new name for the Gulf of Mexico.

An appeals court panel in June 2025 partially lifted a stay in the AP case. It suggested that restricted presidential spaces are not First Amendment forums. Boutrous pointed out that this ruling was non-binding and non-precedential. He also highlighted that the Oval Office and Air Force One have become the primary places where the president interacts with the press.

Boutrous shared data to support this claim

He noted that Trump has fielded more than 4,700 questions in the Oval Office and aboard Air Force One during his second administration. By contrast, he has answered just about 150 questions in the White House press briefing room since January 2025.

Trump has appeared in the briefing room only four times through September of this year. Meanwhile, he held 43 press events in the Oval Office and answered questions aboard Air Force One 51 times.

The attorney argued that these spaces belong to the public. “That is because those spaces belong not to any particular president or administration but to all Americans, and CNN and other members of the press serve as surrogates for the public when covering the White House,” Boutrous wrote.

The DOJ did not respond to requests for comment regarding the letter. A White House official previously provided a combative statement regarding the earlier court order. The official said that the ‘Fake News’ has no place demanding a spot in the President’s Oval Office.

The network is seeking written confirmation that the White House will abandon its policy of exclusion

CNN wants the administration to stop interfering with assigned pool duties. If the White House does not comply, the network plans to return to court. This ongoing tension began on September 18. That was when Trump announced the initial ban on the three news outlets. Journalists discovered their passes were deactivated the following day.

The network has been denied access to the plane for several trips since then. These include visits to the U.N. General Assembly, a football game in Knoxville, and a trip to Texas and Oklahoma, per the Associated Press. The White House has not explicitly told CNN that it is being excluded. The network is now waiting to see if the administration responds to the deadline.
