Arizona man slammed into a tree during a seizure. Then, he was unexpectedly charged with a DUI: ‘I had zero alcohol in my system’

Shea Simmons (@sheasimmonss) from Arizona got into a car accident six years ago. He woke up with swollen eyes and injuries. To his surprise, he alleged that police officers charged him with a DUI.

“This was the day after my birthday—my birthday was yesterday—and the day after we buried my childhood best friend. I had no idea what happened,” Simmons told TikTok. When he woke up, his eyes were closed shut, with a broken back, two rods on his shin, and two rods on his thigh. Simmons said he also broke his right leg, calling the injury one of the “rarest breaks” that could happen to a person.

“I looked at my face, and I started crying. I didn’t think I was ever going to look the same ever again,” he said. Simmons showed photos of his injuries, and he looked purple and swollen. It’s the opposite of what happened to another woman from Michigan whose car tumbled down the freeway and came out unscathed.

When he asked his father what happened, his dad assumed Simmons fell asleep at the wheel. Simmons commented, “No, absolutely not. I remember, it was the middle of the day, three or four in the afternoon, and I was driving home. Next thing you know, I’m in the hospital. I did not fall asleep.” He later found out that he had a seizure on the wheel.

“I had slammed on the gas, and I went across a field, got up to a high rate of speed, and I went into a tree and a railroad track,” Simmons discovered. He said the car also caught fire, and luckily, a witness pulled over and used a fire extinguisher. They pulled Simmons out of the fire through his car’s windshield. Although he survived the crash, the worst part came later.

Being charged with a DUI after a horrific accident

“As you guys know, my three siblings got killed by a drunk driver. They actually charged me with a DUI,” Simmons claimed. When he got to the hospital, Simmons was experiencing a severe head injury. Like this woman who got a traumatic brain injury all because of a middle-school prank, Simmons’ head was fuzzy when police spoke to him.

“I don’t know my name, I don’t know where I’m at, I don’t know my birthday,” he said. The cop allegedly asked him if he’d had anything to drink. Simmons, who was incoherent, allegedly said, “I had a beer and a Suboxone.” He doesn’t know why he said that and said he doesn’t even remember saying those words. Simmons said it wasn’t the truth. However, the police allegedly charged him with DUI.

“Didn’t even know until a couple of months later, during that wreck, someone stole something from my car, and my dad was reporting it stolen,” Simmons claimed. When they pulled up the case of his car crash, Simmons found out about the DUI allegation. Courts were closed in 2020 because of COVID-19, and Simmons wasn’t too ruffled about the charge.

“I pulled up my medical records, like, a couple of years later, and it shows I had zero alcohol in my system,” Simmons said. He maintained his innocence and hired a public defender to take the case. Although it was an additional burden on his part, Simmons managed to get the DUI off his record.
