Belgio’s attorney, Scott O’Sullivan, told WLS that the father of one became critically ill just days after eating raw oysters at the restaurant on June 30. He suffered cardiac arrests that left him without oxygen for at least eight minutes before being revived by the same fire department he once served.
Since then, Belgio has remained hospitalized, with doctors confirming that he contracted multiple pathogens – Enteropathogenic E. coli, Plesiomonas shigelloides, and Vibrio cholerae – from the contaminated oysters. The lawsuit alleges that Belgio did not consume any other raw shellfish between his visit to Gibsons and his hospitalization, making the steakhouse the likely source of his illness.

O’Sullivan described Belgio as “extremely brain damaged, with very little cognitive capacity,” adding that he will likely remain bedridden for the rest of his life. The lawsuit seeks $50,000 in damages, plus costs, though the financial toll is only a fraction of the emotional and physical burden his family now faces.
Belgio’s fiancée, Melanie Stayer, said the ill-fated meal was supposed to be a celebratory one with their 7-month-old daughter, Carmela. Instead, their lives were upended in an instant.

The fund aims to provide the resources necessary for his ongoing care, underscoring the long road ahead for Belgio and his family.
Stayer has used the platform to raise awareness, saying that this could happen to anyone. What was meant to be a casual family outing turned into a life-altering event, proving how quickly circumstances can change.
