Man dines at New Jersey restaurant. Then he gets an email from CapitalOne revealing server added $100 tip: ‘Amex said you never tip this can’t be you’

We’ve all had the experience of going out to eat and spending more than you thought you would.
Most of the time, this is simply due to not paying attention to prices—and maybe having a little fun ordering drinks and appetizers. Sometimes, however, this overspending can be due to trickery on the part of the restaurant.
One man is making such a claim against a New Jersey restaurant. According to TikTok user Omar (@theworldvsomar), a restaurant attempted to charge him over $100 extra—and he only found out thanks to an email from his credit card company.
What Happened During This Man’s Meal?
In Omar’s video, which currently has over 693,000 views, he states, “Today’s word of the day is ‘audacity’—like how this waiter had the audacity to look at my check after I leave and add $107 to the tip.”
Behind him is an email from Capital One. In the email, the bank is confirming whether he truly meant to leave a 39% tip at a restaurant called Blu on the Hudson. As his bill was $274.02, this meant that the tip was $107. The resultant total was $381.02.
“They must [have] thought I was rich,” he writes in the caption.
Is This Illegal?
Yes.
Depending on how exactly the server allegedly attempted to charge the additional tip, they could be in violation of several laws in the state of New Jersey.
If one finds themself in this situation, there are a few things they can do. First, if they notice the error via their credit card bill—or if, like Omar, their credit card notifies them that something suspicious has taken place—they can dispute the transaction.
Additionally, the person can inform the restaurant of what happened. From there, the restaurant will likely try to work out a solution with the customer. This could include offering a refund, or offering additional credit at the restaurant. Internet users have reported success trying to resolve the problem with the restaurant directly.
Commenters Aren’t Happy
In the comments section, several users claimed to have had similar experiences.
“Cheesecake Factory did the same to me,” said a user. “That’s why I lock my card now because how dare you.”
“This happened to me. I did tip appropriately on 1 drink and 2 appetizers. I ended up getting the whole check for free,” recalled a second.
Others simply offered advice on how to combat this in the future.
“Always put a dollar symbol in front of the written amount so they can’t change it,” suggested a user.
“I always take a picture of the receipt after I tip. Always, idc how nice the waiter is for this very reason,” added another. “I’m sorry this happened to you.”
