A Las Vegas woman discovered a blockade in her decision to get a hysterectomy. Why? Because her husband signed a consent form saying no.

In a video with over 1.1 million views, @diaryofahappyblackwoman explained how a quick trip to the doctor for an unrelated issue revealed that her partner does not fully support her childfree life.

@diaryofahappyblackwoman said she wanted to get a hysterectomy for her 30th birthday as a gift to herself. Throughout her TikTok page, she discusses taking joy in being childfree, a reality she seemingly takes pride in.

A routine doctor visit leads to her hysterectomy discussion

A trip to the doctor for a swollen eye from a mosquito bite brought her to her general clinic. She saw her primary doctor, who returned with some blood work she had gotten a week prior. She had already started the process of waiting to get her tubes tied, so she looked over some of the information while in the office.

Her blood work came back fine. Then, her doctor explained that her husband needed to provide consent for her procedure.

The doctor presented two consent forms, one for her and one for her husband, something that baffled @diaryofahappyblackwoman. That is when she found out her husband did not actually support her childfree lifestyle. He denied her ability to get the procedure despite their repeated discussions about being childfree. That decision has since caused marital strain, rocking their relationship’s foundation.

Are doctors still allowed to ask husbands for consent?

While bills across the country have challenged the practice of asking spouses for consent, some clinics still try to follow these outdated policies. An article in the Journal of Gender, Social Policy & the Law said women have been asked for consent from their husbands as late as 2020. “When she asked her doctor if his consent was required by law, the doctor replied that it was not, but it was ‘their policy,’” the publication stated while discussing one case.

“[My husband]  wasn’t informed of this decision, because this is my body and it’s my choice…” @diaryofahappyblackwoman said in her video. As she mentioned later on in her clip, there is no federal law requiring a husband’s consent. Hospital procedures requiring a spouse’s signature are outdated, as Planned Parenthood v. Danforth, 428 U.S. 52 (1976) struck down the precedent.

The state of Nevada does require a consent form and waiting period, but does not specify that a spouse must sign, according to Medicaid paperwork and billing information.

Marital fallout

Many people wondered why her husband did not just sign the procedure, considering the couple had agreed to be childfree long before the appointment. The TikToker mentioned in a follow-up video that her husband’s refusal to sign led to immediate marital problems, despite him being a “good man.” She stayed in a hotel that night rather than going home.

Commenters advocated for a divorce, saying her husband’s decision undermined her agency and bodily autonomy. “You actually do need to divorce him, this is way more serious than you think. The audacity to think he has a say over your body [is crazy],” one commenter wrote.

“Men feel entitled over women and children’s bodies, meaning women and children don’t have autonomy. I’m so sorry lady. I’m convinced ‘good man’ is a facade,” wrote another commenter.

Other viewers had advice for women seeking medical services in 2025, especially after the Dobbs v. Jackson Women’s Health Organization Supreme Court case.

One commenter added, “NEVER tell your physician you are married. The entire time of my marriage my [doctor and] employer thought I was single.”
