Woman shows up to use the pool at her sister’s apartment. Then an officer detains her because she’s ‘trespassing’: ‘All over a pool?’

A woman visits her sister’s apartment complex on a Sunday but can’t get a wristband because the front office is closed. An officer approaches her and accuses her of being “sneaky,” detaining her in his car, and giving a citation for having an “attitude.”

In a video with over 1.3 million views, TikToker Jos (@nnnnylsoj) says that the off-duty police officer works as a contractor for the apartment complex to make sure that only residents and their guests can use the pool.

The officer approaches her and the group and asks to see their wristbands. They walk back to their pool bag to get them, and Jos notes that she doesn’t have one. But before they can explain the situation to the officer, he gets in his car and drives away.

“So, we grab our bags and went to the sand volleyball court,” she says. Then, the officer comes back.

What did the officer say to the women?

The officer asks to see their wristbands again. She explains that she doesn’t have one because the front office is closed. She notes that her sister lives in the apartment complex.

He asks for Jos’s and her sister’s ID and tells them he’s going to give everyone in her group “citations.”

“He said, ‘Someone was being very sneaky saying they were going to get wristbands from the front office,'” she recounts. “I was like, ‘Oh, we didn’t say that.'”

However, the officer quickly claims that Jos has an attitude with him and tells her he is detaining her. He tells her that he won’t give a citation to another girl in the group, Karissa, because she was “quiet.”

Why did the officer detain the TikToker?

As the officer escorts Jos to the back of his car, she starts recording the interaction. Jos calls out the officer for giving her a citation because she spoke up.

“Even if I did give this police officer attitude, that’s not against the law,” she says. “I didn’t like that he was basically trying to call us liars. He treated me like a criminal.”

In the clip of her conversation with the officer, he claims that she was “resisting leaving” the pool after he asked for their wristbands.

Jos asks him why he detained her and gave her a citation, but not her other friend, who didn’t have a wristband. He responds by asking her if she wants him to give her friend a citation and tells her to call her over. The TikToker explains that she is trying to make a point, not cause her friend to get a citation.

“I didn’t want my friend to get a citation but I’m basically telling him make it make sense,” she says at the end of the clip.

She shares that the officer eventually gave her a warning and “a criminal trespassing thing.”

“So I’m not allowed back at my sister’s apartment complex pool,” she says.

I also wasn’t throwing my friend under the bus. I spoke to her after the situation. I was using that as my proof that he was picking and choosing abusing his power only because I gave “attitude”. I clearly wasn’t a trespasser, I was there with my sister who lives in the apartment complex. I got detained for giving attitude, that’s word for word what he told me before walking to his car while other people were let go

What happens if security gives you a citation for trespassing?

Getting “criminally trespassed,” or being served a trespass warning, doesn’t mean the TikToker was charged with a crime. Instead, she has to stay away from the apartment complex pool otherwise she could face misdemeanor charges. This charge can result in jail time and fines, depending on the state.

While trespass warnings don’t typically expire, people who receive them may be able to get them waived by the property that issued them. In the comments, viewers suggest how Jos can repeal the warning.

“You can get the citation dismissed, reach out to the office and the police department and get it removed and show them the videos and make the reports, I’ve done them multiple times for other people as a legal assistant,” one writes.

Another says, “Call the apartment complex to see about getting the criminal trespassing removed asked to speak to the manager if not go to the owner.”

Others suggest she reach out to the police department for body camera footage to back up her story.

“If he’s being hired to monitor a pool that’s moonlighting and not actually police work. I’d be calling the actual police department,” a viewer suggests.

“If he was working off the clock and working for the apartment complex, I promise you, he wasn’t supposed to do any of that,” a second says.

Another adds, “Girl sue and request the body cam footage. Attitude/snarky comments aren’t against the law.”
